CUPE 5167 Vice-President Jay Berberick has been on leave from his job as a City bylaw enforcement officer since becoming his union’s full-time vice president and chief steward on June 24, 2019.
The union, on Berberick’s behalf, grieved after Berberick sought to work overtime shifts as a bylaw officer while on leave at the union.
Arbitrator Brian Sheehan ruled to dismiss the grievance, finding that the union’s contract with the City does not force the municipality to give Berberick overtime shifts while he is on a leave of absence.
